COMMERCIAL LITIGATION
Since the Beginning
From the first contact with a potential client, Scott Hooper works with them to determine the best approach to resolving a commercial conflict. Reaching a satisfactory business solution may or may not involve litigation. Scott believes that cases are often best resolved early, before the parties spend considerable legal expenses and become entrenched in their positions. Usually, the matters resolved early in the process lead to better results for all the parties.
But Scott Hooper is a trial lawyer. If a case cannot be resolved and a trial is the only or best option for a client, he is prepared to go to trial to protect or enforce his client’s rights.
His trial experience began at Vinson & Elkins, one of the largest, most prestigious law firms in the world, which he joined in 1988 after graduating from law school. His first trial was a commercial case — a suit to enforce a loan agreement on behalf of First City Bank of Texas. This was the first of many successful trials on behalf of clients with business and commercial matters in litigation.
In the years since, Scott has handled hundreds of commercial matters for clients.
Personalized Approach
Whether representing a plaintiff or a defendant in a commercial case, Scott’s process is the same. First, he makes sure he understands the full extent of the impact the legal problem poses to his client, the business relationships and goals that might be affected by the options for resolving the problem and the client’s own goals. Then he diligently pursues strategies he and the client have developed together – strategies consistent with the client’s business and litigation objectives.
It’s not exactly that simple. Scott focuses particularly on complex litigation. But as far as Scott’s clients are concerned, it might as well be that simple. Scott tries to make it as easy for his clients as possible.
Here are some of the areas in which Scott has handled commercial matters for both companies and individuals:
- Breach of Contract
- Asset Purchase Agreements
- Vendor Agreements
- Municipal Waste Processing Plant Contracts
- Construction Contracts
- Consumer Contracts
- Broker/Dealer Fraud and Malfeasance
- FINRA Arbitration
- Fraud in the Auction Rate Securities Market
- Oil and Gas Leases, Take-or-Pay Litigation and Distribution Agreements
Team Approach
The Scott Hooper Law Firm executes a business strategy that is uncommon for law firms.
